Tenant rights and small claims: what you can do yourself

17 years of experience
Email verified

I have practised landlord-tenant and consumer law in Missouri for seventeen years, much of it in legal aid before going into private practice. A great deal of what people pay lawyers for in this area they can genuinely do themselves, and I would rather tell you that. The situations I see constantly: a security deposit withheld without the itemised statement the law requires, an eviction notice that is defective on its face, repairs the landlord will not make, and a debt collector calling about a debt that may be past the limitations period. Each of those has a specific written response that works, and the response matters far more than the argument. Small claims court is designed to be used without a lawyer and most people are intimidated out of it. I will walk you through filing, what to bring, and what the judge will actually ask. This is general legal information for your situation, not representation, and I will say plainly when the stakes mean you need a lawyer on the record.
